Questions
Review and Adjustment is a four step process:
-
An
administrative review may be requested by either party
to the support order thirty-six (36) months from the
date of the most recent review. Every 36 months, the
CSEA shall initiate an administrative review of a IV-D
case in which money is owed to the state
If the time
period is less than the 36 months, an individual can
request
a review provided one of the following criteria is met:

Income of
one of the parties has increased or decreased by 30%.

Either
party had a loss of employment that was beyond his/her
control.

The
support order is over three years old.

One of the
parties is permanently disabled, institutionalized
or incarcerated and cannot pay support for the duration
of the child’s minority.

Upon
completion of the emancipation/termination process, a
Review and Adjustment for the remaining children on the
order can be requested.

A minimum
support order was entered at the time of the original
order.

Both
parties are sent financial information packets. Parties
have forty-five (45) days to complete and mail the
packets back to the CSEA. If the requesting party does
not return the packet, the review will be denied.
The revised
order shall be included in an Administrative Findings and
Recommendation. The recommendations shall include a notice
that either party has the right to request an administrative
hearing if they do not agree with the adjustment. If no
hearing is requested, the revised order shall be submitted
to the court.

If an
administrative hearing is requested, the hearing shall
be scheduled within fifteen (15) days after receiving
the request.

The
hearing decision shall be issued within ten (10) days of
the hearing. Either party can object to the decision
and request a court hearing within fifteen (15) days of
receiving the hearing decision. If no hearing is
requested, the revised order is filed with the court.
